Terms of Service
Welcome to Utopia VR, a product of Infinite World Games Inc. ("Utopia VR," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website, VR and desktop applications, developer tools, and related online services (collectively, the "Platform"). By creating an account or accessing the Platform, you agree to these Terms and our Privacy Policy. If you do not agree, you must not use Utopia VR.
1. Eligibility and Account Requirements
- You must be at least 13 years old (or 16+ in the EU) to use Utopia VR.
- By using the Platform, you confirm that you can form a legally binding contract with us.
- If you are under 18, you must have your parent or legal guardian's permission to use Utopia VR.
- You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
- We may suspend or terminate accounts that violate these Terms or our Code of Conduct.
2. Use of Platform
You may use the Platform only for lawful, personal, and non-commercial purposes, unless otherwise authorized in writing by Infinite World Games. You agree not to:
- Violate any law, regulation, or community standard;
- Harass, threaten, or harm other users;
- Upload or distribute illegal, obscene, or infringing material;
- Reverse-engineer, modify, or interfere with Platform software or servers;
- Circumvent moderation tools or anti-cheat systems;
- Access another user's account without permission;
- Use bots, scripts, or automated tools to manipulate activity or content.
We reserve the right to investigate and take appropriate action, including suspension or termination of access.
3. Virtual Worlds, Content, and User Creations
3.1 Your Content. You may create, upload, or share text, images, avatars, environments, sounds, or other digital content ("User Content") within Utopia VR. You retain ownership of your original content, but grant Utopia VR a worldwide, royalty-free, sublicensable license to use, reproduce, display, adapt, distribute, and promote your content within the Platform and for marketing or demonstration purposes. You represent and warrant that you have all rights necessary to share the content; that it does not infringe third-party rights; and that it complies with the Code of Conduct and applicable laws.
3.2 Platform Content. All other content — including the Platform software, logos, 3D assets, and branding — is owned by Infinite World Games Inc. or its licensors and protected by copyright, trademark, and other intellectual property laws. You may not copy, sell, distribute, or create derivative works from any Platform content without our express permission.
4. Payments, Credits, and Subscriptions
4.1 Virtual Currency. Utopia VR may offer digital tokens or credits for purchasing virtual items, assets, or access to premium experiences. Credits have no real-world cash value and may not be exchanged for money or outside services. We reserve the right to change pricing, credit values, or in-game economies without notice.
4.2 Purchases and Refunds. All purchases are processed securely through authorized payment providers (e.g., Steam, Meta, Tilia). By completing a transaction, you agree to their applicable payment terms. Except where required by law, all sales are final.
4.3 Creator Earnings. Approved creators may earn revenue from content sales or events. Payment processing, tax compliance, and account verification are managed through authorized partners. Utopia VR may suspend or withhold payouts in cases of suspected fraud, abuse, or violation of these Terms.
5. Data, Privacy, and Security
Your use of the Platform is governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using Utopia VR, you consent to the processing of your information in accordance with that policy. You are responsible for protecting your device, connection, and any information you share with others within the Platform.
6. Community Standards and Enforcement
You must follow our Code of Conduct at all times. Violation of the Code, these Terms, or any applicable law may result in temporary or permanent account suspension; removal of content or privileges; revocation of earned credits or creator access; and reporting to law enforcement if required by law. Utopia VR reserves the right to moderate, remove, or restrict access to any content or feature at its discretion to maintain community safety.
7. Intellectual Property and DMCA
We respect intellectual property rights. If you believe your copyrighted work has been used in violation of the law, please submit a Digital Millennium Copyright Act (DMCA) notice to: Copyright Agent, Infinite World Games Inc., email info@infiniteworldgames.com. Include your name, contact info, a description of the copyrighted work, and a statement under penalty of perjury that you are authorized to act on behalf of the owner.
8. Third-Party Links and Services
The Platform may include links to third-party apps, SDKs, or content. We are not responsible for the privacy, security, or conduct of third-party services. Use them at your own discretion and review their respective policies.
9. Disclaimers and Limitation of Liability
Utopia VR is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the Platform will be uninterrupted, error-free, or completely secure. To the maximum extent permitted by law, Infinite World Games is not liable for indirect, incidental, or consequential damages; and your sole remedy for dissatisfaction is to stop using the Platform.
10. Indemnification
You agree to indemnify and hold harmless Infinite World Games Inc., its officers, employees, partners, and affiliates from any claims, damages, or expenses arising from your use of the Platform, your User Content, or your violation of these Terms or applicable law.
11. Termination
We may suspend or terminate your access at any time if you violate these Terms or misuse the Platform. You may close your account at any time by contacting info@infiniteworldgames.com or using the in-app account deletion feature. Upon termination, all rights granted to you end immediately; any accrued obligations (e.g., payments, indemnity) will survive.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law principles. Any disputes will be resolved through binding arbitration under the American Arbitration Association (AAA) rules, unless prohibited by local law. You waive any right to participate in a class-action lawsuit. EU/UK users retain their mandatory consumer protection rights under local law.
13. Changes to These Terms
We may update these Terms to reflect platform changes, legal requirements, or new features. We'll notify users of material updates through in-app notifications or email before they take effect. Continued use of the Platform after updates means you accept the revised Terms.
